makeupintel.com is a beauty-focused information and community platform. We may feature product listings, ingredient information, reviews, discussions, rankings, filters, editorial content, and other community-submitted material.

The Site is designed to help users research beauty products more easily, but it is not a substitute for professional advice, personal testing, or your own judgment.

You must be at least 13 years of age to use the Site. If you are under the age of majority in your state or country, you may only use the Site with the permission and supervision of a parent or legal guardian.

By using the Site, you represent that:

• you can legally enter into these Terms;
• the information you provide is accurate;
• your use of the Site will comply with applicable law.

• interfere with security, performance, or functionality;
• evade bans, suspensions, filters, or moderation tools.

Reviews and ratings must reflect your genuine personal opinion and actual experience.

You must not:

• post fake reviews;
• post reviews for products you have not actually used or meaningfully experienced;
• accept payment, gifts, discounts, or incentives to post a review without a clear disclosure;
• coordinate review campaigns intended to mislead;
• manipulate "helpful," "glow," "like," or similar engagement signals;
• post on behalf of a brand, competitor, or retailer without clear disclosure.

We may remove or label reviews that we believe are fake, misleading, abusive, duplicated, incentivized without disclosure, or otherwise inconsistent with the integrity of the Site. The FTC's current rule specifically targets deceptive reviews and testimonials, including fake reviews and review suppression.

Sponsored content and gifted products. If you received a product for free, at a discount, or in exchange for a review — or if you have any other material connection to the brand or product — you must clearly and conspicuously disclose this in your post. A disclosure must be prominent and unambiguous (e.g., "gifted," "PR sample," "paid partnership"). Burying a disclosure in a hashtag pile or small print is not sufficient. This applies regardless of whether your opinion is positive, negative, or mixed.

"User Content" means anything you post, upload, submit, transmit, or otherwise make available on the Site, including reviews, comments, photos, videos, swatches, usernames, profile text, ratings, forum posts, messages, and feedback.

You retain ownership of content you own.

However, by submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, transferable, sublicensable licence to host, store, reproduce, publish, display, perform, distribute, modify, adapt, translate, reformat, excerpt, analyse, moderate, promote, create derivative works from, and otherwise use that User Content for purposes related to operating, improving, securing, promoting, and developing the Site and our services.

This licence includes the right to use User Content:

• in connection with search, discovery, ranking, moderation, anti-fraud, and safety systems;
• in marketing, promotional, archival, internal, and operational materials;
• to improve features, recommendations, categorisation, and product tools;
• for artificial intelligence, machine learning, or similar training, testing, evaluation, and improvement purposes.

You represent and warrant that:

• you own the content you submit or have all rights needed to submit it;
• your User Content does not infringe any third-party rights;
• your User Content is not false, misleading, or unlawful.

We are not obligated to keep User Content confidential.

If you send us suggestions, ideas, bug reports, recommendations, or feedback, you agree we may use them without restriction or compensation to you.

We reserve the right, at any time and for any reason, to:

• review, moderate, remove, edit, or restrict content;
• suspend, limit, or terminate accounts;
• block access to features or the Site;
• investigate suspected violations;
• report content or conduct to law enforcement or relevant third parties where appropriate.

We may do this with or without notice, and at our sole discretion. We are not responsible for failing to remove content, removing content, or removing content later than you would have liked.

Except for User Content and third-party materials, the Site and its content, design, layout, branding, text, logos, graphics, databases, software, and other materials are owned by us or our licensors and are protected by copyright, trademark, and other laws.

You may not copy, reproduce, republish, distribute, modify, frame, mirror, sell, license, or exploit any part of the Site except as permitted by law or with our written consent.

Your notice should include:

• your name and contact information;
• identification of the copyrighted work you claim has been infringed;
• identification of the allegedly infringing material and where it appears on the Site;

• a statement, under penalty of perjury, that the information in your notice is accurate and that you are authorised to act on behalf of the copyright owner;
• your physical or electronic signature.

We may remove or disable access to material claimed to be infringing and may terminate repeat infringers.

If you believe your content was removed in error, you may send a counter-notice containing the information required by applicable law.

The Site may link to third-party websites, retailers, marketplaces, brands, and services. We do not control and are not responsible for third-party content, products, services, availability, pricing, policies, or practices.

Your use of third-party websites is at your own risk and subject to their own terms and policies.

To the maximum extent permitted by law, the Site is provided "as is" and "as available." We disclaim all warranties, express or implied, including warranties of:

• fitness for a particular purpose;
• non-infringement;

• uninterrupted access.

We do not warrant that the Site will be error-free, secure, current, or free of viruses or harmful components.

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, or opportunity, arising out of or relating to:

If we are found liable to you for any claim arising out of these Terms or the Site, our total liability will not exceed the greater of: the amount you paid us in the 12 months before the claim arose; or US$100.

You agree to indemnify, defend, and hold harmless us, our affiliates, and our respective officers, owners, employees, contractors, and agents from and against any claims, losses, liabilities, damages, judgments, costs, and expenses, including reasonable legal fees, arising out of or related to:

• your use of the Site;
• your User Content;
• your violation of these Terms;
• your violation of any law or third-party rights.

We may suspend or terminate your access to the Site at any time, with or without notice, for any reason or no reason, including where we believe you have violated these Terms or created risk for the Site or its users.

Sections that by their nature should survive termination will survive, including those relating to licences, intellectual property, disclaimers, limitation of liability, indemnity, and disputes.

We may update these Terms from time to time. The updated version will be effective when posted, unless otherwise stated. Your continued use of the Site after changes are posted means you accept the revised Terms.

Before initiating any formal legal proceedings, you agree to first contact us and give us a reasonable opportunity to resolve the dispute informally. You must send a written description of the dispute to us by email, and we will attempt to resolve it within 30 days of receipt.

If we are unable to resolve the dispute informally within that period, either party may then pursue the matter through the courts in accordance with section 21 below. Nothing in this section prevents either party from seeking urgent injunctive or other equitable relief from a court where necessary.

These Terms are governed by the laws of NSW, Australia, without regard to conflict of law principles.

You agree that any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the courts located in Sydney, Australia, unless applicable law requires otherwise.

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Site, you agree to the collection, use, and disclosure of your information as described in the Privacy Policy. Please read it carefully.

If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions of these Terms will continue in full force and effect.

These Terms, together with our Privacy Policy and any other policies or notices published on the Site, constitute the entire agreement between you and us regarding your use of the Site, and supersede all prior and contemporaneous understandings, agreements, representations, and warranties — whether written or oral — relating to that subject matter.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
